| dc.description.abstract | حاول المشرع الجزائري حماية المستهلك من كل المخاطر والممارسات غير المشروعة التي تهدد أمنه الاجتماعي و الاقتصادي، باعتباره الطرف الضعيف في العلاقة الاستهلاكية، ومن بين هذه الممارسات غير المشروعة المضاربة غير المشروعة، تفشت هذه الجريمة بشكل كبير خلال الفترة الأخيرة التي صاحبت تأزم الوضعية الصحية وظهور فيروس COVID 19 وهذا ما ساعد مرتكبي هذه الجريمة على استغلال هذه الأوضاع الحساسة بهدف تحقيق أرباح ومكاسب مادية، وبالتالي ظهرت أشكال مستجدة لهذه الجريمة ما جعل قانون العقوبات الذي يعالج هذه الظاهرة عاجز على الإلمام بها من جميع الجوانب، وهذا ما دفع المشرع إلى إلغاء هذه الجريمة في قانون العقوبات، وقام بإصدار قانون خاص بمكافحة المضاربة غير المشروعة رقم 21-15 ، إذ قام المشرع الجزائري بتحديد أهم صور هذه الجريمة وأركانها، وبيان مجموعة من التدابير الوقائية للحد منها بناءً على معالجة الواقع والتحديات الفعلية، وكشف استراتيجيات التي يعتمدها المضاربين، وفي جانب آخر من هذا القانون نص المشرع على الجزاءات الردعية التي توقع على المتورطين في حالة ثبوت هذه الجريمة. The Algerian legislator attempted to protect the consumer from all risks and unlawful practices that threaten his social and economic security, considering the weak party in the consumer relationship. Among these unlawful practices are smuggling practices that have significantly grown during the period affected by the COVID-19 pandemic. This contributed to the exploitation of these sensitive conditions to achieve material gains and profits. Consequently, new forms of crime have emerged, which made the penal law unable to address this phenomenon that spread across all states. This prompted the legislator to include this crime in the penal law and to issue a special law to combat smuggling under Law No. 15-21. The Algerian legislator has specified the most important forms of this crime and its methods, between procedural measures to limit them and practical challenges. The strategies adopted by smugglers were revealed. Alongside this, the law stipulates deterrent sanctions aimed at protecting citizens from falling into the traps of these crimes. | |
