| dc.description.abstract | حظيت مسألة منازعات العمل الجماعية باهتمام المشرع الجزائري، حفاظا على استقرار العلاقات المهنية التي تعد خلية التنمية الاقتصادية، نظرا لتأثيرها السلبي على المجالات الاقتصادية والاجتماعية والمهنية. ويجب على المشرع التدخل لتنفيذ آليات حل النزاعات الناجمة عن تضارب المصالح بين العمال وصاحب العمل بالطرق السلمية والمشروعة. وينظمه القانون رقم 08-23 المتعلق بمنع وتسوية المنازعات الجماعية في العمل وممارسة الحق في الإضراب. ولم يغفل المشرع تنظيم أحد الحقوق الدستورية التي يلجأ إليها العامل كوسيلة للضغط للاستجابة لمطالبه بطريقة مشروعة قانونا. The issue of collective labor disputes received the attention of the Algerian legislator, in order to preserve the stability of professional relations, which are the cell of economic development, because of their negative impact on the economic, social and professional fields. The legislator must intervene to implement mechanisms for resolving disputes resulting from conflicts of interest between workers and the employer through peaceful and legitimate means. It is regulated by Law No. 08-23 regarding the prevention and settlement of collective disputes at work and the exercise of the right to strike. The legislator did not neglect to regulate one of the constitutional rights that the worker resorts to as a means of pressure to respond to his demands in a legally legitimate manner. | |
